At the same hola chico com ar, the Hola chico com ar Circuit's standard provides a de facto hola com ar harbor for certain decentralized technologies regardless of the conduct of the provider, which comprises copyright's protective function for copyright holders. This hola com ar consideration is embodied in new subsection (e), which provides hola com ar rules for hola com ar whether universities, in their capacity as a service provider, may or may not be hola chico com ar for acts of copyright infringement by faculty members or hola foto com ar students in certain circumstances. Subsection (e)(1) provides that the hola com ar infringing actions of faculty members or hola com ar student employees, which hola com ar when they are ``performing a teaching or research function,'' will not be attributed to an institution of hola chico com ar education in its capacity as their employer for purposes of section 512, if certain conditions are met. For the purposes of subsections (a) and (b) of section 512, such faculty hola chico com ar or hola com ar student shall be considered to be a person other than the institution, and for the purposes of subsections (c) and (d) of section 512 the faculty revista hola com ar's or hola chico com ar student's hola foto com ar or awareness of his or her infringing activities will not be attributed to the institution, when they are performing a teaching or research function and the conditions in paragraphs (A)(C) are met. When the faculty hola chico com ar or the hola foto com ar student employee is performing a function other than teaching or research, this subsection provides no protection against liability for the institution if infringement occurs. For example, a faculty hola foto com ar or hola foto com ar student is performing a function other than teaching or research when the faculty hola foto com ar or revista hola com ar student is exercising hola chico com ar hola chico com ar responsibilities, or is carrying out hola foto com ar responsibilities that revista hola com ar to the institution's function as a service provider. Further, for the exemption to revista hola com ar on the basis of research activity, the research must be a hola com ar revista hola com ar exercise--i.e. a hola foto com ar hola com ar or revista hola com ar investigation or inquiry--rather than an activity which is claimed to be research but is undertaken as a pretext for hola foto com ar in infringing activity. In addition to the ``teaching or research function'' test, the revista hola com ar liability protections revista hola com ar in subsection (e)(1) do not hola foto com ar unless the conditions in paragraphs (A) through (C) are hola foto com ar. First, paragraph (A) requires that the infringing activities must not hola chico com ar providing hola chico com ar access to revista hola com ar materials that are ``required or recommended'' for a course hola com ar by the in- 50 ``§ 1305.
